Description
Many disputes have come about between (i) the archdeacon and precentor of the church of Moray regarding teinds (by way of the prebends of Forres, Rathven, and Alves) and the rectors of the church of Keith (in the name of the church of Moray) regarding the teinds of Strathisla (in Keith, BNF), and (ii) the abbot and convent of Kinloss. On the advice of Worthy Men, and with the will and agreement of the parties involved, an agreement has been reached over the said prebends and churches. With the agreement and approval of the chapter of Moray, the archdeacon and precentor have quitclaimed all the right they claimed to have in respect of their prebends and churches of Forres, Ruthven, and Alves, and the rectors of the church of Keith have quitclaimed all the right they claimed to have in respect of that church, revoking all suits. The terms are as follows. Concerning the land of Strathisla (in the parish of Keith) and their lands in the parishes of Forres, Rathven, and Alves, when they shall have been given at ferme, either whole or in part, the parish churches in whose parishes the said lands are sited shall receive all the teinds and church dues from the fermers. Concerning the lands not given at ferme, the monks shall be exempt from payment of teinds because of their privileges. Moreover, the Bishop of Moray in the name of the church of Moray has also renounced in full and for ever to the same church every right and demand applicable to him and the church of Moray in respect of that side of the land which is called Kirkburn, by the agreement of the dean and chapter of Moray. The Abbey and convent of Kinloss, in respect of the lands sited in the parishes of the said prebends and churches shall be quit and free for ever from every demand and payment of teinds according to the terms of their privileges, except that for the sake of peace, as an obligation they shall each year pay to the bishops of Moray 3 shillings and 4 pence, to the archdeaconry 3 marks, to the precentory 10 shillings, and to the church of Keith 6 marks, in the following manner: if the said monks have given at ferme the whole of their lands sited in the parishes of Forres, Rathven, Alves, and Keith, or in any of those parishes, the church in whose parish the land given at ferme is situated shall fully and wholly take all the teinds and church dues from the fermers of the said lands. But if the monks have given at ferme a certain part of the lands situated in the said parishes they shall be quit of the whole portion of the said money, and released in proportion to the land given at ferme, with respect to those in whose parishes the lands given at ferme were situated, and the remaining amount shall be paid. So that the said 3 shillings and 4 pence each year for ever shall be paid to the bishops of Moray in return for the King’s teinds from Burgie (MOR), and these above-said things shall be paid accordingly each year at the feast of St Martin in winter.
