- Description
- Court of Linlithgow held on Tuesday before the feast of All Saints, regnal year of King Edward 30 (27 Oct. 1302)
Essoin. Adam of Glasham, defendant, essoined (i.e., excused) himself against Thomas the engineer on the plea of trespass by [Nicholas] ‘William’ of Derby, testifying on oath.
Essoin. The same Adam essoined(i.e., excused) himself against Christina of Edinburgh on the plea of trespass from the law (unde lex), by the same William. And later the said Christina came and challenged that essoin, and said that according to the law of Scotland, after the law was waged (i.e., legal action put into motion), the essoin must not be allocated. And the court said the same. Therefore, the decision is that Adam le Fosseour (the Diker) and William of Derby , the aforesaid pledges of Adam, be distrained that he may be at the next court for the hearing of his judgement.
Thomas the engineer, plaintiff, presented himself against Adam of Glasham, essoiner, on the plea of trespass. And he has a day at the next court.
