Document 4/32/70 (Pais. Reg., 174-5)
- Description
- [Laurence], dean of Carrick, [Richard], dean of Cunningham, and [Alan], master of schools of Ayr recite a mandate of Pope Gregory [IX], appointing them papal judges-delegate in the case of the abbot and convent of Paisley concerning rights and ownership of certain of its churches. Since the abbot and convent of Paisley had taken action against Dufgall, son of Christian, late judex of Lennox, before the judges, concerning a certain land which he held from the east of the church of (Old) Kilpatrick (DNB), and concerning a certain land above the River Clyde called ‘Cultbuche’, which lands the monks claimed were unjustly alienated from the church of (Old) Kilpatrick; and since Dufgall had decided not to respond to the intention of the monks, on the day fixed by the judges, but had receded contumacious, whence the judges, by the counsel of prudent men and or skilled judges, decreed the monks to be in possession of the land, and by the chaplains of Renfrew and of Govan demanded that the decree be executed. Therefore Dufgall, should he not provide proof of right within a year, the judges adjudge true possession of the lands to the monks, saving to Dufgall the complaint of ownership concerning those lands.
