- Pope Urban III writes to the prior of Newburgh and the archdeacon of Dunkeld, reporting that when Bishop H[ugh] of St Andrews recently visited the pope, there arrived a Master W., representative of the monks of Durham, who claimed that he was to prosecute an appeal on their behalf. The following discussions, in which arguments were presented for the monks against Bishop Hugh and vice versa, can be related orally. The pope commits the case, with the consent of both parties, to them, stipulating that the contesting parties should be convoked within the kingdom of Scotland to a suitable place where the judges are to inquire into the matter, and the avenue of appeal being closed, to render a decision. If they cannot terminate the case, they should command the litigants by apostolic authority to present themselves before the pope within the octaves of the feast of Saints Peter and Paul for a judgement. In the meantime, they should send a written, sealed account of the proceedings to him, so that he can render an equitable decision. If, following a legitimate appeal, or after the aforementioned bishop has departed for the apostolic see, anything is attempted prejudicial to any right, they should rectify the situation. If letters prejudicial to either party were impetrated on behalf of the bishop or the representative of the monks, while these people were at the papal curia, they should be set aside.
