Document 3/363/2 (C.A. Chrs., no. 10)

Description
Adam son of Abraham of Lour has given [granted and by this his charter established?] to David Ruffus of Forfar and his heirs which he may have by his betrothed wife, Kincreich (ANG) that was Adam’s with its right borders, and to the increase of a certain part of the territory of Lour (ANG), by the following boundaries, given herein, free from all custom and exaction and secular demand, with common pasture of Lour, rendering annually 2 ½ marks, one mark 10d. on Pentecost and one mark 10d. on Martinmas, and making forinsec service of the lord king as pertains to one davoch of Kincreich and as pertains to a tenth part of two davochs in Lour, free and quit from all other service and aid and custom and exaction and secular demand, saving to Adam a site for his mill, which ought to be placed on the land away from that part of the stream where it now sits, that is, towards Forfar. David may grind his corn from Kincreich and Lour at the mill with multure if he wishes. If he wishes, David may also spend every Tuesday and the following night at the mill without any obligation of work or aid. Any suit which shall have arisen against David’s men will be settled in Adam’s court in the territory of Lour, and David and his heirs will have half the forfeiture and Adam the other half; and any suit arising among David’s men shall be settled in his court and David will have the whole forfeiture. If any suit shall have come to Adam by default of David, it will be settled in Adam’s court of Lour, half of the forfeitures to go to David and half to Adam. If it happens that David has no heirs, David is empowered to bestow this holding on the monks of Coupar Angus, saving the above ferme and forinsec service to the king, and saving the site and watercourse of the mill.

This charter is contained in an inpection by Nicholas, abbot of Scone, Master Robert de Stuteville, dean of Dunkeld, and Robert, treasurer of Dunkeld, dated at Dunkeld on 5 Mar. 1271 or 7 Mar. 1273, probably the former (2/98/3).
