Description
Abbot Patrick of Dunfermline, Abbot Henry of Arbroath, Abbot Reimbald of Scone, Abbot Guy of Lindores, Prior Thomas of St Andrews, Prior John of May, Prior Berengar of Restenneth, Ralph, archdeacon of St Andrews and the deans and canons who took part in the synod at Perth, on 11 April 1206, make known that in the case called between William, of good memory, bishop of St Andrews and Duncan of Arbuthnott, concerning the land of Arbuthnott (KCD) called Kirkton, which the same bishop said belonged by right to the church of St Andrews and of which Duncan had deprived the said church and thus claimed the lawful boundary. The authority of the synod had been generally applied, that is, that the case of the court having been heard, that the same bishop claimed to hold the land himself, [and] the contradiction of the opposing party having been heard, by common assent of all who took part in the synod they have promulgated the sentence, awarding the possessions and property of the land, and the men who remain there, to St Andrews and Bishop William, and imposing perpetual silence on Duncan. And so that the proceeding of business may be known in full, the attestations of whose authority they deferred the sentence are written below. The testimony of the following individuals is recorded in detail: John of Hastings, sheriff of Kincardine, Isaac of Benvie, Adam of Benvie, his nephew, Master Isaac, a clerk of the bishop, incorporating testimony from the late Walter Scott (I), Felix, former persona of Arbuthnott, Hathekin the priest, Maurice or Muiredach the priest, Hugh, the bishop’s steward, Andrew ‘de Bas’, brother of Bishop Hugh of St Andrews, Brice, persona of Newdosk, Gillepedair, an old man, Mael Coluim of Idvies, Cormac of Newdosk and Somerled of Fetteresso.
